FCPA Video Presentation Methods and Costs

A 6 minute preview of the FCPA Compliance and Education Video is located below.

To assist our corporate clients with both FCPA education and compliance, The Directors Letter has joined with the international audit firm KPMG to develop a simple and straightforward training and compliance solution to this FCPA risk. Prevention is the first responsibility, detection the second and ongoing compliance the third.

Daly & Company, a 35-year-old Boston firm, along with its subsidiary, The Directors Letter, focuses on training and education matters related to corporate governance and compliance, such as the Foreign Corrupt Practices Act.

The content of the FCPA Video is applicable to the board room, internal audit, as well as the legal department. It is especially relevant for training the field sales force. It is based on a fast paced video interview between a principal at KPMG specializing in FCPA matters and a former U.S. prosecutor. We have found an interview, rather than a lecture format, is easier to follow and encourages critical audience participation from your employees.

The training session covers the FCPA definitions, the risks, the detection, compliance and prevention. We offer the product in three presentation formats, depending on your company’s in-house capabilities and your desire to manage specialized training sessions.

Three Versions and Related Costs

1. The first version is a DVD, approximately 35 minutes in length, with three breaks for your comments and audience discussion along with Q&A. The cost is $5,000 for unlimited usage.

2. The second version is the FCPA Video presented online and fully managed by us through a WebEx training webinar. It will be conducted at a specific time scheduled for your company’s call-in participants. This will also involve online Q&A. The cost is $15,000, which includes the video, the Q&A with the presenters and up to 25 participants.

3. The third version is an on-site seminar presentation, again utilizing the basic FCPA Video, but accompanied by the individuals involved in the interview or their counterparts who would be present at your location. This presentation will be customized for your specific business and involve considerably more audience interaction. The cost of this session will be $25,000, which includes the video, all participants plus travel expenses. In most cases, this will involve a two to three hour presentation and is most effective with up to 75 people attending.

Bribery does not simply happen; it can be based on a lack of knowledge or a company culture that is perceived as tolerating it. In the eyes of the SEC or the Department of Justice, neither is a defense. What may be perceived by those in the field as simply “an in-country custom” or “the cost of doing business,” may actually be a federal crime.

Documented training on the subject of bribery, monitoring of corporate detection policies and overall compliance is the best defense.
